What is mobile home “Detitling”?

Mobile home detitling, also known as manufactured home detitling, is a process of removing the legal title of a mobile home or manufactured home from the state's records. This is typically done when the mobile home is permanently affixed to a piece of land and becomes a fixture of the real property.

Detitling a mobile home means that the home is no longer considered personal property, but rather is part of the real property. This can be important for homeowners who want to obtain a mortgage or refinance their home because it allows them to obtain a traditional mortgage instead of a personal property loan, which often has higher interest rates.

Detitling a mobile home usually involves submitting paperwork to the state's Department of Motor Vehicles or other relevant agency. The process can vary depending on the state, but typically requires proof that the home is permanently affixed to the land and that any outstanding liens or loans on the home have been satisfied. Once the detitling process is complete, the mobile home is considered part of the real property and the owner will receive a new deed reflecting the change.

Why use MHTR for Detitling?

The process of detitling a mobile home or manufactured home can be challenging and complex for several reasons:

  1. State regulations: Each state has its own set of regulations regarding the detitling process, which can vary significantly.
  2. Affidavit of Affixture: One of the most important documents required for detitling a mobile home is the Affidavit of Affixture, which is a legal document that confirms the mobile home is permanently affixed to the land. This document must be completed accurately and signed by the appropriate parties, including the landowner, the mobile home owner, and a notary public.
  3. Liens and outstanding loans: If there are any liens or outstanding loans on the mobile home, these must be paid off or satisfied before the detitling process can be completed. This can be a lengthy and expensive process, particularly if there are multiple liens or loans on the home.
  4. Structural requirements: In order for a mobile home to be considered permanently affixed to the land, it must meet certain structural requirements, such as being anchored to a permanent foundation. If the mobile home does not meet these requirements, the detitling process may be delayed or denied.

Overall, detitling a mobile home can be a complex process that requires careful attention to detail and compliance with state regulations.
